Dear Process Server:

I thought the knock on my door late last night (9:30 PM) was a misdelivered pizza. Did it ever occur to you that people may be in their pajamas at that hour? Maybe, oh, settling down for BED? I am not that hard to find, despite the fact that the summons had an incorrect address. There are almost always two (2) cars in the driveway, day and night. I'm a stay-at-home parent, so surely you could have picked a better hour to serve me this paper. And to top it off, your summons was for me to appear for a deposition for the EEOC vs. Some Sorry Company I Haven't Worked For In 4 Years And Had No Beef With Other Than An Unemployment Claim. I mean, it's not like I am guilty of anything. I'm just sayin'...

Good Grief. Are they insane. The only way I answer te door at 9:30 at night is w/ a BB gun behind my back.(I asked Dh for a baseball bat, I got a bb gun).

that's just inconsiderate. i'm glad my mon taught me some manners. i have a 2-year old and get up for work at like 4 am, and i hate it when people call my house at like midnight. what could be so important?

Wendy: Yeah, I am going to confront the deposition company about it when I go. I e-mailed a woman I used to work with and she said hers came at 9 PM also.

Stringman: No, I only have to give a deposition. Though I may visit great bodily harm upon the person who told the server to serve the paper any time of the night. Then I WILL be on AMW!

Brandy: Normally I would have brandished my sword (or the butterfly knife) but the Citizen answered the door first.

Spider walk: A classmate at martial arts said I could get out of it by calling and saying I had nobody to care for my two children. Actually I am just tempted to go and give them a piece of my mind for the timing in delivery of the papers.

Zambo: Glad you liked the list.

April: Ditto for my mom. I unplug the phones after the kids go to bed. And I turn off my cellphone when I go to bed. It's amazing how many "wrong" numbers we get here at "Herding Cats".

Dear Junebee - My mom is a private investigator and a professional, registered process server. We both think that it was very rude of that person to arrive so late and wake you up like that.

Everybody is entitled to "due process" of law under the 5th and 14th Amendments to the Constitution. And witnesses should especially be treated with kindness and respect, we think, particularly if the requesting party wants to avoid a hostile witness. If we can, we even try to call the witness to arrange a convenient time for service.

The only time my mom would EVER have someone served after 8:00PM is if they'd been hostile or evading and she had no other choice. Meanwhile, I can tell you that most professional process servers would have treated you with the respect and consideration you obviously deserve.

We are sorry that you had such an unfortunate experience. :o)
